US Marshalls Unleashed On Copyright Troll Righthaven

Righthaven, that right winger backed organization that goes after small bloggers for “copyright infringements”, is in a lot of trouble:

Looks like it's time to turn out the lights on Righthaven. The US Marshal for the District of Nevada has just been authorized by a federal court to use "reasonable force" to seize $63,720.80 in cash and/or assets from the Las Vegas copyright troll after Righthaven failed to pay a court judgment from August 15.

Righthaven made a national name for itself by suing mostly small-time bloggers and forum posters over the occasional copied newspaper article, initially going so far as to demand that targeted websites turn over their domain names to Righthaven. The several hundred cases went septic on Righthaven, however, once it became clear that Righthaven didn't own the copyrights over which it was suing. Righthaven, ailing, was soon buffeted by negative court decisions as a result.

In August, the case Righthaven v. Hoehn was tossed by a federal judge in Nevada, who went a step further and declared that defendant Wayne Hoehn's complete copy of a newspaper article in a sub-forum on the site "Madjack Sports" was fair use. On August 15, the judge awarded $34,045.50 to the Randazza Legal Group, which represented Hoehn. Righthaven, which had spent so much time thundering to defendants about just how badly the federal courts would make them pay... didn't pay.

Oh Yes He Did! Herman Cain Plays The Race Card

Well that didn’t take long:

On FOX News' "Special Report" tonight presidential candidate Herman Cain told the panel, after being asked, that he believes the charge of sexual harassment against him has to do with his race.

Charles Krauthammer: "Mr. Cain, when Clarence Thomas was near to achieving position of high authority, he was hit with a sexual harassment charge. You contending for presidency, the office of highest authority, leading in the polls for the Republican nomination, all of the sudden get hit with a sexual harassment charge. Do you think that race, being a strong black conservative, has anything to do with the fact you've been so charged? And if so, do you have any evidence to support that?"

Herman Cain: "I believe the answer is yes, but we do not have any evidence to support it. But because I am an unconventional candidate running an unconventional campaign and achieving some unexpected unconventional results in terms of my -- the poll. We believe that yes, there are some people who are Democrats, liberals who do not want to see me win the nomination. And there could be some people on the right who don't want to see me -- because I'm not the

'establishment candidate.' No evidence."

"Relative to the left, I believe that race is a bigger driving factor. I don't think it's a driving factor on the right. This is just based upon our speculation," Mr. Cain also said.

BREAKING: Four Georgia Men Arrested In Plot Against Government

Domestic terrorism anyone?

Four suspected members of a fringe north Georgia militia group were arrested Tuesday by federal authorities and charged with plotting to buy explosives and trying to make a deadly toxin in a bizarre plot to attack unnamed government officials.

The four men in their 60s and 70s were part of a group that also tried to obtain an unregistered explosive device and sought out the complex formula to produce ricin, a biological toxin that can be lethal in small doses, according to a federal complaint.

The four listed in the indictment are Frederick Thomas, 73; Dan Roberts, 67; Ray Adams, 65; and Samuel Crump, 68. The men live in the north Georgia towns of Cleveland and Toccoa.

They have been talking about "covert" operations since at least March 2011, according to court records, discussing murder, theft and using toxic agents and assassinations to undermine the state and federal government.

According to federal authorities, Thomas, Roberts, Adams and others who attended the meetings discussed targeting various government officials, including employees of the IRS. The meetings were monitored and tape recorded by a confidential source for the FBI, authorities said.

Anti-IRS and government? I think it’s safe to say which side of the political spectrum these idiots belong too. Sadly that won’t silence the rhetoric from the right. Instead we can expect another circling of the wagons as they ignore more attempts at domestic terrorism. Sadly it’s going to take a lot of lives and property loss before common sense may begin to prevail.

Is Cain Under A Confidentiality Agreement For Something He Can’t Remember?

NPR is out with this story that really makes things look bad for Cain:

The lawyer for a woman who settled a sexual harassment complaint against Republican presidential candidate Herman Cain in the late 1990s says that Cain may have violated the confidentiality terms of the agreement by commenting on its specifics over the past 24 hours.

"Herman Cain and others have already disclosed that there was a confidential settlement," says Joel P. Bennett, a Washington-based attorney specializing in employment law, who also represented the woman when she negotiated her settlement.

Two women, including Bennett's client, settled sexual harassment complaints against Cain when they worked for him during his late 1990s tenure as head of the National Restaurant Association.

One of the biggest defenses the right has been pulling out is that the women who talked to Politico are “anonymous”. They somehow think that vindicates Cain, but this shows the problem with that. These women can’t talk about it publicly or they risk violating this agreement. Instead we now have Herman Cain possibly violating it and that could lead to legal trouble for the GOP front runner.

Obama uses executive orders as a political tool

President Barack Obama is crafting his own laws of political physics these days, insisting that inaction by a divided Congress requires White House action in order to get something done.

A campaign labeled "We Can't Wait" pushes unilateral directives and programs from the White House as the only way to push ahead on the president's agenda when a do-nothing Congress fails to act.

"There is inaction. There is a lack of action," White House Press Secretary Jay Carney explained to reporters this week when asked about a series of executive orders and actions the president has taken or is planning. "So there is a need to move, because we can move."

Funny, but I can’t seem to find any similar headlines when Bush decided to use executive orders to limit abortion funding. I guess to CNN that was Bush just being “presidential”, yet let Obama use executive orders and he’s turning them into a “political tool”.

Rick Santorum Wants Herman Cain To Be More Forthcoming On Sexual Harassment Allegations

Since news erupted Sunday night of past sexual harassment allegations against GOP front runner Herman Cain we have heard the same old meme from the right – “it’s the liberal media”. Given how this is a constant defense for the right, despite one of the primary authors of the article being a former reporter for one of the best known conservative publications, it makes it even more interesting that Rick Santorum is now embracing the Politico article:

Former Pennsylvania Sen. Rick Santorum’s presidential campaign is calling on Herman Cain to offer a more detailed explanation of the sexual harassment allegations made against him during his time as the head of the National Restaurant Association.

“What I would encourage the Cain campaign to do is, if you are the frontrunner and you plan to be the nominee, to be forthcoming so that you are vetted, and we don’t get into a situation where you’re our nominee and we find out things after the fact,” said Santorum strategist John Brabender, speaking at an election preview forum hosted by National Journal.

Santorum’s campaign is the first of Cain’s opponents to jump on the allegations that have been lodged against him. Politico reported late Sunday that two women reached settlements with the NRA in the 1990s after accusing Cain of sexual harassment.

Loudon VA. GOP Sends Out Email With Image Of POTUS Shot In The Head

This is absolutely disgusting:

The Republican Party of Virginia is strongly condemning an e-mail sent by Loudoun County’s GOP committee that shows President Obama as a zombie with part of his skull missing and a bullet through his head.

“The disgusting image used today on a mass e-mail has no place in our politics. Ever,’’ said Pat Mullins, chairman of the state party. “The Republican Party of Virginia condemns the image and its use in the strongest possible terms.”

Even more disgusting is the Loudon GOP’s attempt at an apology:

Mark Sell, chairman of the Loudoun County Republican Committee, issued a statement that said:

“The Loudoun County Republican Committee yesterday sent an email to its members that represented a light-hearted attempt to inject satire humor into the Halloween holiday,’’ Sell wrote. Apparently, some individuals have interpreted an image of Barack Obama that appeared within the email as intending to portray the president as a victim of a violent crime. Nothing could be further from the truth, and we deeply and sincerely apologize to the president and anyone who viewed the image if that was the impression that was left. The LCRC deplores any effort to display, suggest or promote violence against the president or any other political figure.”
