More On The Latest WSJ Poll

The Wall Street Journal/NBC poll which was released yesterday is very
interesting. It comes from the Journal, which is one of the more conservative
publications in the country. I have been diving into the actual findings of the
poll and want to share them now (to view the actual poll, click

Question 1. Is the country headed in the right
direction?

Ironically the lowest point in history for that question was in July of 1992,
during Bush seniors Presidency when 14% thought the country was heading in the
right direction as opposed to 71% who didn't. The highest point was in September
of 2001 when 72% thought the country was heading in the right direction (which
was taken in the aftermath of 9/11).

Question 2. Do you approve of President Bush's
job?

Still Little Known About Miers.

On the day after President Bush's announcement of Harriet Miers as nominee to
the Supreme Court we are starting to find out very limited information.
President Bush is apparently predicting a fight with this nomination considering
he called a press conference today in which he used his time to mostly reaffirm
his decision.

Abortion rights is going to be the hot topic of this confirmation. While
there is no real paper trail to follow on Miers,

Mercury News
has interviewed Lorlee Bartos, who managed Miers run for Dallas
City Council in 1988. Bartos said "She (Miers)  is on the extreme end of
the anti-choice movement". So far NARAL has not come out in opposition of Miers.

During her time as a city councilwoman, Miers did support civil rights for
gay and lesbians, as well as backed AIDS education programs

has learned.

During President Bush's conference today he made mention of a possible block
by Democrats. Apparently the President hasn't weighed in with fellow
Republicans, who could also be a hard sell. Senator Sam Bronback (R-Kan) was
questioned today and said he questioned rather Miers has a "firm commitment" to
the "original intent" of the United States constitution. While Brownback did not
come out in full opposition to the nominee, he did pave the way to lead a
Republican opposition to Miers.

This confirmation is most likely not going to be clean and uneventful as the
confirmation of John Roberts. Right now the only real paper trail lies within
the White House, and the President has already said he will invoke executive
privilege to prevent those papers from being released.

Nomination Round 2

Cronyism is at it again and this time it comes in the form of a Supreme Court
Justice. Today President Bush nominated long time friend and confidant Harriet
Miers to replace retiring Justice Sandra Day O'Connor.

Miers has no judicial experience, so there will be no paper trail to base her
upon. This will make it even more of a challenge for Senate to confirm her.

Miers is a 60 year old female who graduated from Southern Methodist
University and its law school. She has served on Dallas's city council in the
early 1990's and as president of the Texas Bar Association before taking over as
the Texas lottery commissioner.

Miers came to Washington with Bush in 2001 where she served as staff
secretary and deputy chief of staff during his first term. Last year, Miers was
appointed to White House Chief Council, replacing Alberto Gonzalez. Bush once
described Miers as "a pit bull in size 6 shoes".

With no previous judicial experience, we are most likely to see a filibuster
come from the Democrats on this nominee. The confirmation hearings should be
rather interesting. Will she give more or less answers than John Roberts? If she
gives any less then they might as well save the time and not even have them.

 

Roberts Confirmed

John Roberts has been confirmed by Senate and is now sworn in to take the
seat of Chief Justice. Only 22 Senators voted against Roberts, making him the
17th person to serve as Chief Justice to the Supreme Court.

Now there is talk that the second nominee to fill Sandra Day O'Connors seat
could come as early as this week. Sources close to the White House have revealed
that President Bush is down to under 10 potential nominees. If President Bush
goes with a hard line conservative, a Democrat filibuster will most likely
follow.

Specter Urges Delay in Replacement of
O'Connor at Supreme Court

Sept. 21 (Bloomberg) -- The chairman of the Senate Judiciary Committee
said he urged President George W. Bush today to delay nominating a
replacement for retiring Justice Sandra Day O'Connor.

Senator Arlen Specter, Republican of Pennsylvania, said he talked to
Justice O'Connor about staying on the high court. ``She's prepared to do
that'' through the court's term ending in June, Specter said. The president
``was noncommittal,'' Specter said. ``The body language was not very
positive,'' Specter said.

Specter said the delay would give Congress and the rest of America more
time to know John Roberts as chief justice. ``When we know a little more
about Judge Roberts it's going to be easier with the next'' nomination,
Specter said.

Senate Majority Leader Bill Frist of Tennessee said he urged Bush to
submit a name to the Senate promptly. ``I feel we should proceed with the
nomination as anticipated,'' Frist said. If so, the confirmation process
could be completed ``around Thanksgiving.''

O'Connor, 75, often a key swing vote on the Supreme Court, announced on
July 1 that she is retiring and agreed to stay on until her replacement is
confirmed. She has said she wants to help care for her husband, John
O'Connor, who is suffering from Alzheimer's disease.

Specter and Frist, together with Senate Democratic leader Harry Reid of
Nevada and Patrick Leahy of Vermont, ranking Democrat on the Judiciary
Committee, spoke with reporters at the White House after meeting with Bush
over breakfast.

Roberts Dodges The Question Of Roe

Arlen Specter just finished his first round of questioning
with John Roberts. It was interesting watching the “pro-choice” Republican try
to get answers out of Roberts. In a usual tactic that is employed during
confirmation hearings, especially those for the Supreme Court, Roberts refused
to answer questions on the specific case of Roe V. Wade. He did however state
the he believes in the precedence of a court and the “jolt” that overturning
prior decisions can cause on the legal system. He also reaffirmed that personal
belief should not interfere with legal precedence. Specter also provided a chart
of 36 prior cases that upheld the precedence of Roe V. Wade.

Specter also hit on the controversy surrounding Roberts and
his views of personal privacy. Robert’s some what danced around the question but
did say he believes the Constitution offers a clear number of protections to
personal privacy.

I will post any other pertinent information as the hearings
continue.

 

An Historical Event This Week

We are now into a historical week. While Senate is holding
confirmation hearings on John Roberts and coverage still comes out of the Gulf
Coast, there is another event happening in New York that is of paramount
interest.

The United Nations will be hosting leaders from all over
the world this week in the largest summit of its kind. This will also mark the
debut of none other than John Bolton.

The ideals and plans that Bolton has for restructuring of
the United Nations is already causing turmoil with some of our staunchest
allies. Take for example this paragraph from the
Guardian this week.

The Guardian has learned that Jack Straw, the foreign
secretary, has made a personal plea to his American counterpart, Condoleezza
Rice, for the US to withdraw opposition to plans for wholesale reform of the UN.
He has asked Ms Rice to rein in John Bolton, the US ambassador to the world
body.

Our number one ally in the war in Iraq is now breaking away
from us in order to try and preserve the United Nations.

These concerns are not only concerns of our ally, but also
concerns of a majority of the leaders. John Bolton has taken the plans for
restructuring of the United Nations and butchered them into something that could
have only been envisioned by the Project for a New American Century.

We learned over the last couple of weeks that we can not be
alone in the world. We need friends abroad to help us out when disaster strikes.
The United Nations supplied us aid after being delayed by our own government and
it was aid desperately needed.

Result of Last Poll

I closed out the last poll that I had running. The question of John Roberts
being a good Justice yielded a record response. Out of 194 votes, 83% said no,
13.4% did not know, and only 3.6 % said yes.

I will have another poll up shortly. I am modifying the code a little to make
it a little more user friendly.

I have just added a new polling question. I ran the
previous question for approximately 1 month and had the following results:

Do you feel America is certain to experience another
terror attack on our home front?

Yes – 70%

No – 17%

Uncertain – 13 %

There were a total of 30 votes in that poll. The new poll
question is posted regarding John Roberts. Please cast your vote.

New View on Judge Roberts

Its seeming more and more like Bush played the ultimate trump card by
nominating John Roberts. He has gone out, picked someone with a short lived
bench life and there for does not have many opinions to show how he would vote
on controversial issues such as Roe V Wade. Short of him being a pot head or
hiring illegal aliens to work for him, he is sure to get confirmed.

The deal made by the seven Republican and seven Democratic Senators will seem
to stand firm during this confirmation also. The promise was not to filibuster
unless it was extreme circumstance, and I can not find one that would be extreme
when it comes to confirming John Roberts. The only down votes I can fore see
with this nomination would come from the extreme sides of both aisles. The far
right might say he is not conservative enough while the extreme left would
oppose his lack of opinions on issues such as abortion.

This varies greatly from my first opinion of the man, but after a day of
research I can truly say that he might be the best we could expect from George
Bush. The even better side of this is that we will see less attention on his
confirmation and more attention on Karl Rove. Poor Karl even made the front page
of the Washington Post today, where it talked about the State Department memo
marking Valerie Plames identity as secret. This is should help keep the
journalistic flames turned up on President Bush and Scott McLellan.

It is still disheartening to see that our President doesn't take leakers that
serious. Rove now has to be convicted of a crime to be punished, and not just
involved. This kind of message is not a good one to come from the President who
vowed to restore integrity to the White House. I guess in Michael Jackson's
defense, it is ok for parents to send their kids back over to Never Land Ranch
also!
