Judge Throws Out Wiretapping Charges Against Maryland Motorcyclist

You may recall the story of Anthony Gruber. In July of this year he was speeding down a highway. An undercover police officer pulled a gun on him to stop him. Gruber was videotaping his joy ride and decided to post the video on YouTube, a decision that ultimately lead to his arrest and being charged for a violation of Maryland’s wiretapping law. Gruber faced up to 16 years if convicted.

Well it turns out common sense has prevailed and a judge has thrown out the wiretapping charges against Gruber, leaving only the moving violations for him to face. In his decision, the judge made perfect sense:

"Those of us who are public officials and are entrusted with the power of the state are ultimately accountable to the public," the judge wrote. "When we exercise that power in public fora, we should not expect our actions to be shielded from public observation."

Isn’t it a shame that those who enforce the law can’t use the same type of common logic when deciding who to charge and who not to charge?

This Is Why Democrats Lose

TPM has obtained a list of new talking points being about the Scott Brown victory being circulated by Democrats:

It is mathematically impossible for Democrats to pass legislation on our own. Senate Republicans to come to the table with ideas for improving our nation and not obstructionist tactics.

When did Republicans ever say “well we only have a 9 seat majority, we can’t do any of our plans”? Answer – NEVER. Republicans never even had a 9 seat majority. The weak kneed leadership the Democrats have just want to curl up in a ball and cry.

Then there’s this point I just love. It kind of goes hand in hand with the one above:

When they were in control, Senate Republicans voted seven times to raise the debt limit and refused to pay for the costs of major initiatives. Their claims of fiscal purity do not square with their record of wasteful spending and excess.

And yet they were able to do this without having a 10 seat majority. How in the world can they even put this tainted logic to print?

So why even vote for Democrats now? Really – the Senate Democrats just made us ask ourselves that. Have a super majority is a very uncommon thing in the Senate, with the last time being in 1965. Now the Democrats are saying “well we can’t do anything unless we have a super majority again”, or in other words, “go ahead and stay home Democrats”.

This really shows that Democrats excel at one thing – being losers. We need a tidal wave of new blood in the party to push out the old farts, who are driving the Democratic party into the grave with them.

Everyone has had to see this graph by now. It’s the one put out by Nancy Pelosi’s people.

The blue line is the 1990 recession, red is 2001 and green is current. Just looking at that you start to comprehend the seriousness of the current financial situation.

Now let’s consider this. Republicans attribute the Bush tax cuts to getting us out of the 2001 (red) recession. The estimated cost of those tax cuts is $1.35 trillion. The current stimulus bill is at $800 billion, and even Republicans say it could cost up to a $1 trillion. Now look at that graph again and how much more serious today’s recession is than the 2001 one. See where I’m going? Republicans are complaining that this stimulus costs too much, yet we are much worse off than in 2001 and the bill is actually less.

Like I have been saying all along; the Republicans don’t really want a cure to the current economic problems. They want a way for the economy to remain the same or get worse so that they can hit the campaign trails in a few months saying “see the Democrats are making us hurt”. This is a pure example of putting ideology above country and something we can’t let happen. Hopefully we can get some surrogates out there for the Democrats echoing this message and informing America how the Republicans arguments are not only failing in logic, but also risking putting our nation in a bigger purgatory.

Cycling Debate Hits The Blogosphere

I have missed the debate going on about cycling safety and sharing the road that has emerged in the blogosphere this past week. As an avid cyclist, I am glad to see this debate gain more attention, as I feel it is very important.

Ezra Klein has linked some excellent posts that show how the debate is evolving, but the disturbing part is the comments on these blogs. So many people believe that cyclists have no right on the road, so that gives motorists carte blanche to do what they want to them. To those people - you are so wrong.

In most states, cyclists enjoy the same laws as motorists. There are those foolish cyclists that don't follow the laws, but there are also drivers who ignore the laws of the road. That means the people trying to blame it all on the "crazy cyclists" or kids on bikes, should also point the finger to the idiotic driver behind the wheel of a car.

There's also debate the cyclists don't get the same use of the roads, because we don't pay taxes. Damn - I want a refund! This has to be the poorest argument I have ever heard. By that same logic, semi drivers should be allowed to do whatever they want, even if that means running soccer mom and the kids off the road so the semi can make it's delivery. After all, truck drivers pay the most in taxes when it comes to the road.

The Media Kind Of Pays Attention To Iraq

Of course what they are paying attention to is a poll that says McCain leads Obama and Clinton on the issue of Iraq by 14%. They also seem dumbfounded by the results. Really? I'm not.

Here's why McCain is doing good in that part of the poll. The fault lies in the same people who are wondering why - the media. McCain has made numerous gaffs on Iraq in the past few weeks, which would have proven fatal to any Democrat. Instead the media covers them up for John. They dismiss them as "senior moments" or just let's them go unchallenged. It's part of that love fest we have witnessed between McCain and the media, and it's disgusting.

Do you really think McCain would be doing this well on the question of Iraq if the media did their job and reported that McCain doesn't even know who the enemy really is?

Just because he fought in a war doesn't make him commander ready. If we followed that logic then we should expect a President Lynndie England in the future.

So Why Are People Flocking Towards Obama?

Well if you listen to the MSM you would think it was because of the spat between him and Hillary over race. That doesn't seem to be the case though:

Only six weeks ago at a focus group conducted by pollster Peter Hart, Ewing, who is black, said she was in Clinton camp's because America wouldn't vote for a black president. ``Iowa made me change my mind.''

No mention of the Hillary spat there. Of course the MSM thinks we are all tools who will vote for who they want and can't change our minds without them telling us to. That is the big flaw in their logic and why they continue to look like total idiots.

Are Bio-fuels Increasing Food Costs?

It doesn't look like it:

The recent price rally in farm commodities such as grains, oilseeds and sugar beet can be attributed partly to higher biofuel demand but their share of the blame has been exaggerated, a top official of the Organisation for Economic Cooperation and Development (OECD).

Loek Boonekamp, a division head in the Agro-food Trade and Markets Division at the Paris-based OECD, said the surge in farm product prices -- with cereals more than doubling last year -- would have happened even without the rise in biofuel production.

"Closing your eyes and blaming the current high prices to biofuels is just too simplistic," he told the Reuters Global Agriculture and Biofuel Summit.

The deniers want to blame the people trying to save our planet and ourselves for all the problems. The flaw in their logic is that it's false. Now we have proof coming that their claims are baseless, and that proof is from a food manufacturer. Of course they will try to spin this some other way.

Who Declares War Hillary?

Hillary told Tim Russert that Bush would have gone to war against Saddam with or without a resolution. Excuse me, but WTF? That's not a good statement for someone who wants to be President to make. Congress declares war - not the President. If he would have gone to war without the resolution then that is a serious ground for impeachment.

So her logic is that Bush would have done what he wanted so they might as well give him what he wants? That very logic totally nullifies the premise of checks and balances.

I keep wanting to lean towards Hillary when it comes to my support, but comments like this push me back to Obama. How I wish Edwards would have a break out moment.

Just Because You're Born Gay Doesn't Mean You Have To Act Gay

I guess this logic has played well for the GOP in the past. Just ask Mark Foley. He tried so hard to conceal his sexuality that it allowed him to go after children. These Republicans are about the sickest lot of idiots to come across the radar in years.

Does One Constitutional Right Out Trump Another?

When they talk about warantless wiretapping, Republicans are quick to say that the constitution should take a back seat to security. Well if we follow that login and apply it to the following news headlines this week, perhaps other rights should take a back seat:

So let's take the Republican logic on our freedom of privacy and apply it to the second amendment. Perhaps it is time that we suspend it in the name of safety. Of course the Republicans and NRA will quickly denounce such a move, but we can easily call what is happening in our country terrorism.

Let's look at that logic from our President, and applying it to other countries.

Germany - They could let Nazis take back over the country

Russia - They could restart the cold war

UK
- They could try to put us back under their rule.

Japan - They could bomb Pearl Harbor again.

The world is full of "they coulds", but do we wage war on everyone because of that? No - but Bush appears to now use that as his justification. It's no wonder the whole world frowns upon us now. Before long they might develop their own lists of "they could", except we will be the subject of it.

Brown People Need Not Apply

Mitt Romney:

. . . based on the numbers of American Muslims [as a percentage] in our population, I cannot see that a cabinet position would be justified. But of course, I would imagine that Muslims could serve at lower levels of my administration.

The hidden lesson here - cabinet positions are filled based upon population, not qualifications. Yeah that makes sense.

Now considering that Romney is Mormon and people following the Mormon fate dropped between 1990 and 2000, while Muslims increased during the same time period, I guess we could apply the same logic to him being President. I don't think there are enough Mormons in this country to justify a Mormon President. How's that for religious bigotry? Or does it only apply to people the Republicans don't like?

So which of the Republican front runners isn't a redneck, racist asshole (or at least pretending to be)?

Surge Past Training

While all the news agencies is busy comparing the recent friendly fire deaths in Iraq to the death of Pat Tillman, Editor and Publisher has the scoop on something even more disturbing regarding the incident:

One of the soldiers died just hours after arriving in Iraq -- and was one of those troops rushed to the country in the "surge" who did not receive full training.

Not even a month after this happened, Tony Snow was making light of the news that troops were being rushed into combat, without training.

Q There was also a report this morning that two Army combat brigades are being sent to Iraq without desert training — the Associated Press has a story out today — and that it’s because they’re being rushed to Iraq to help get the surge in place.

MR. SNOW: Again, let me stress, what happens is, a lot of times you will also do training in theaters, as well as equipping in theater. The generals have made it very clear, and military commanders have made it clear, nobody is going to go into combat activity without proper equipment and training. Period. So if things –

Q But the story flatly says that two brigades are going in without desert training in California. So that doesn’t sound like –

MR. SNOW: All right, I understand.

Q — they’re getting the training.

MR. SNOW: Well, but they can get desert training elsewhere, like in Iraq.

The part that really gets me wondering is this:

I can say with certainty that the Quds force, a part of the Iranian government, has provided these sophisticated IEDs that have harmed our troops. And I'd like to repeat, I do not know whether or not the Quds force was ordered from the top echelons of government. But my point is what's worse -- them ordering it and it happening, or them not ordering it and it happening? And so we will continue to protect our troops.

Bush's All Spin Zone Presser

Bush and Ed Henry from CNN just had an interesting exchange regarding the roadside bombs. Henry was simply looking for more concrete evidence to the claim Iran is supplying the bombs in Iraq. Bush responds with:

It is preposterous to think that we would be manufacturing intelligence!

Isn't that what got us into Iraq in the first place? What is preposterous is to think that Bush would present actual intelligence.

Something else sticks out regarding this entire "Iran bomb" fiasco. The proof the administration is using is that the bombs are coming from the Qud army, which is part of the Iranian government. Well do we have proof these are coming from the Qud army, or is it coming from some rogue people in the army?
