Prosecutors To Drop Charges Against Strauss-Kahn

We knew this was coming:

Prosecutors will ask a judge to dismiss all charges in the sexual assault case against former IMF director Dominique Strauss-Kahn at a court hearing on Tuesday, the New York Post reported on Sunday, citing unnamed sources.

The Manhattan district attorney's office will file a motion recommending the case be dropped and laying out the chronology of events that led to that point, according to the Post.

Strauss-Kahn, who has denied the allegations, was once seen as a leading contender to be president of France until a maid, Nafissatou Diallo, accused him of sexual assault on May 14 at New York's Sofitel Hotel. He was arrested and forced to resign as head of the International Monetary Fund a few days later.

This is a man who has had his life destroyed over a bogus allegation and over-zealous prosecutors. He has already been given a life sentence and it wasn’t one imposed by the courts. Hopefully those responsible will be held accountable.

Killing Children In The Name Of God

When we hear about the extremes some Muslims go to when they punish spouses or children, a lot of Christians quickly blast the faith. It's funny how quickly they forget a lot of the same "punishments" are also taught in the bible, but not Kevin and Elizabeth Schatz:

Three years ago, Kevin Schatz and his wife Elizabeth did something so noble, a local television station featured them; the pair decided to adopt three children from Liberia. Now, they're accused of killing one of the children because she mispronounced a word.

Prosecutors say that the California couple used quarter-inch plastic tubing to beat their seven-year-old adopted daughter to death. 

Apparently, they got the idea from a fundamentalist Christian group, which promotes this as a way of training children to be obedient.

Beck’s Fraudulent Sponsors

Glenn Beck might, for once, be right: the government iscoming for your gold. But only if you happened to buy it from one of Beck's advertisers, the Superior Gold Group. At the request of prosecutors from LA County and Santa Monica city who have filed a civil suit against the company, Los Angeles County judge has ordered that Superior Gold be placed into receivership and all of its assets—bank accounts, real estate, and presumably gold stored for customers—frozen. On Monday, a court-appointed lawyer actually physically seized control of the company, presumably to prevent further wrongdoing. The lawsuit alleged that among other things, Superior had defrauded its customers by overcharging them, fraudulently inducing them to buy overpriced collectors' coins rather than the bullion that they wanted, and taking customers' money for coins they never produced. The prosecutors hope that the lawsuit will provide restitution for all of the company's ripped off customers. The judge will hold a hearing later this month to decide whether the company's assets should remain frozen until the case goes to trial.

A Morgan Stanley wealth manager will not face felony charges for a hit-and-run because Colorado prosecutors don't want him to lose his job.

Martin Joel Erzinger, who manages more than $1 billion in assets for Morgan Stanley in Denver, is being accused only of a misdemeanor for allegedly driving his Mercedes into a cyclist and then fleeing the scene, Colorado's Vail Dailyreports. The victim, Dr. Steven Milo, whom Erzinger allegedly hit in July, suffered spinal cord injuries, bleeding from his brain and, according to his lawyer Harold Haddon, "lifetime pain."

The reason for the reduced charges?

“Felony convictions have some pretty serious job implications for someone in Mr. Erzinger's profession, and that entered into it," Hurlbert said. "When you're talking about restitution, you don't want to take away his ability to pay."

"We have talked with Mr. Haddon and we had their objections, but ultimately it's our call," Hurlbert said.

So the guy is to well off to face what the law wants?

Prosecutor In Stevens Case Commits Suicide

ted_stevens The whole investigation into the handling of the late Ted Stevens prosecution took a really interesting turn this weekend:

One of the prosecutors who handled the corruption trial of Alaska Sen. Ted Stevens committed suicide over the weekend, according to his lawyer.

Justice Department prosecutor Nicholas Marsh and five others have been the subject of an investigation by the Justice Department's Office of Professional Responsibility over their handling of the Stevens case, which the Justice Department ultimately dropped amid charges the government did not properly share evidence with Stevens' defense attorneys. The judge in the Stevens case also ordered a special prosecutor to look into it.

Bob Luskin, an attorney for Marsh, told CNN Marsh killed himself but did not provide details. "It did seem he was overwhelmed by the emotional cost of this investigation," said Luskin. According to the attorney, Marsh was in his late 30s.

And for those that can’t remember before 2009, this case was handled by the Bush DOJ, a DOJ that had a lot of questionable practices and was accused of being “politicized”. The final report on this investigation should read like a John Grisham novel.

Former Ky. State Rep Caught With Nude Images Of Underage Girls On His Computer

LEXINGTON - Former state Rep. Steve Nunn had pornographic images of girls between the ages of 10 and 12 on a hard drive recovered after his ex-fiancee was found murdered last fall, a Lexington police detective said Thursday.

The external hard drive was found in a box that Nunn, 57, had asked a friend to hide for him the night before the killing, according to testimony during a hearing in Fayette Circuit Court.

The hearing was held to determine whether police and prosecutors can continue searching the hard drive.

No decision was made, and Judge Pamela Goodwine set a second hearing for Aug. 16.

Nunn, who is being held in the Fayette County jail, waived his right to appear Thursday. He faces the death penalty in the shooting death of his ex-fiancee, Amanda Ross, 29, of Lexington.

States Pushing Investigations Into Nelson’s Deal

Another court battle over the health care reform is brewing:

The top prosecutors in seven states are probing the constitutionality of a political deal that cut a funding break for Nebraska in order to pass a federal health care reform bill, South Carolina's attorney general said Tuesday.

Attorney General Henry McMaster said he and his counterparts in Alabama, Colorado, Michigan, North Dakota, Texas and Washington state - all Republicans - are jointly taking a look at the deal they've dubbed the "Nebraska compromise."

"The Nebraska compromise, which permanently exempts Nebraska from paying Medicaid costs that Texas and all other 49 states must pay, may violate the United States Constitution - as well as other provisions of federal law," Texas Attorney General Greg Abbott said.

This isn’t even limited to just red state, but blue states as well. The deal Nelson got stinks big time, but honestly these are the same types of games we have seen in Washington for years. Remember the “Bridge to Nowhere”? It’s a practice that each party campaigns on fixing until they get in power, then they fall in love with it all over again.

Let’s Talk About Those White House Party Crashers

The story of the White House party crashers is apparently the only thing that has happened over the extended weekend if you listen to MSNBC, so let me take a moment and bring up my thoughts.

There is a lot of finger pointing going on with this. Some are blaming the Secret Service, while others point the finger at the White House. The latter is completly obscene, but if the right wants to travel that path then let’s remind them of a man who posed as a reporter for a fake publication and sat in the White House press briefing room for a couple of years under Bush. Jeff Gannon not only sat in the briefing room, but also was in attendance when countless foreign leaders were visiting. Security at these events are much more relaxed than they are during a state dinner.

But I really want to focus on the Secret Service. Yes there was an apparent failure here, but what caused that failure? People seem to be ignoring the fact that President Obama has received more threats than any other president, so the Secret Service is stretched thin trying to keep the President safe as it is. The fact that Obama has been such a big target of threats has become a laughing issue for the right, which it is not. It’s a very serious issue, and one that the Secret Service takes very seriously. Perhaps it’s time to increase the size of the Secret Service.

Then there is the issue of what to do with the couple. Many are calling for criminal charges. I’m sure prosecutors can find something to charge the couple with, but will it stick? The most I can think of charging them with is trespassing and that is a rather minor crime. Instead of being out for blood we should be looking for solutions, like not allowing this to happen again.

Felonious Pharma

While progressives are still celebrating the passage of healthcare reform by the House, there seems to be amnesia when it comes to who we are dealing with – big pharma. One thing missing in healthcare reform that really should be there is dealing with situations like this:

On the morning of Sept. 2, 2009, another Pfizer unit, Pharmacia & Upjohn, agreed to plead guilty to the same crime. This time, Pfizer executives had been instructing more than 100 salespeople to promote Bextra, a drug approved only for the relief of arthritis and menstrual discomfort, for treatment of acute pains of all kinds.

Record High Fine

For this new felony, Pfizer paid the largest criminal fine in U.S. history: $1.19 billion. On the same day, it paid $1 billion to settle civil cases involving the off-label promotion of Bextra and three other drugs with the U.S. and 49 states.

You think that a fine like that would cause these practices to stop, but take a few minutes and read the entire article on Bloomberg and you will see that Phizer is a repeat offender and they aren’t alone. Every other big pharma company engages in the same illegal activity, they get fined and continue to do it.

The fact is that Pfizer makes huge profits. They made $2.88 billion in the third quarter last year alone, so this fine doesn’t even wipe out the profits of 3 months. These aren’t fines they are getting, they are the cost of business.

How Bad Are Those Prisoner Abuse Photos?

When President Obama changed his mind and said he wouldn’t release those photos I figured it had to be something really bad.

At least one picture shows an American soldier apparently raping a female prisoner while another is said to show a male translator raping a male detainee.

Further photographs are said to depict sexual assaults on prisoners with objects including a truncheon, wire and a phosphorescent tube.

Another apparently shows a female prisoner having her clothing forcibly removed to expose her breasts.

Detail of the content emerged from Major General Antonio Taguba, the former army officer who conducted an inquiry into the Abu Ghraib jail in Iraq.

Reading this I kept thinking back to 2003 when Bush and his ilk were out there saying “Saddam has these rape and torture rooms”. Well guess what? So do we..

As we continue to learn more about Gitmo and Abu Gharib its becoming harder to believe that Abu Gharib was just a few soldiers acting on their own ambitions. We already know that what we saw happening in the original Abu Gharib manuals pretty much mimic what the EIT memos were saying. That means someone either gave orders/guidance or we have just seen the king of all coincidences.

No matter what cause Abu Gharib to occur, one thing is for certain. We now need a full blown inquiry. It mustn’t be limited to one facility, but to the military and intelligence community as a whole. This is the kind of investigation that only Congress along with a army of prosecutors can delve into. Hopefully this latest report will put us closer to that reality, and that reality is that this happened at the hands of the U.S.:

Still Trust Our Democracy?

From Lexington, Kentucky:

Five Clay County officials, including the circuit court judge, the county clerk, and election officers were arrested Thursday after they were indicted on federal charges accusing them of using corrupt tactics to obtain political power and personal gain.

The 10-count indictment, unsealed Thursday, accused the defendants of a conspiracy from March 2002 until November 2006 that violated the Racketeering Influenced and Corrupt Organizations Act (RICO). RICO is a federal statute that prosecutors use to combat organized crime. The defendants were also indicted for extortion, mail fraud, obstruction of justice, conspiracy to injure voters' rights and conspiracy to commit voter fraud.

According to the indictment, these alleged criminal actions affected the outcome of federal, local, and state primary and general elections in 2002, 2004, and 2006.

UBS Bank To Pay $780 Million To IRS

The employer of Phil Gramm, the very man who championed to get rid of banking regulations and served as an economic adviser to the McCain Campaign, has been busted:

UBS AG, Switzerland’s largest bank, will pay $780 million to avoid U.S. prosecution and settle regulatory claims that it helped thousands of wealthy Americans use Swiss bank accounts to avoid paying taxes.

UBS agreed to resolve claims by the U.S. Justice Department that the bank helped U.S. citizens hide accounts from the Internal Revenue Service, the U.S. government said in statements released today. Prosecutors won’t pursue criminal charges if UBS makes promised reforms while paying $400 million in tax-related payments. The bank must also disgorge $380 million under accords with prosecutors and the Securities and Exchange Commission.

The agreement resolves SEC claims that it acted as an unregistered broker-dealer and investment adviser to thousands of U.S. citizens who held accounts directly or in the names of others. UBS spokesman Mark Arena wasn’t available for comment.

I bet they aren’t too happy at UBS about this. Perhaps Gramm will call them a company of “whiners”.

Problem Solved?

Last night President (shiver) Obama ordered the prosecutors at Gitmo to halt all cases for 120 days. Most likely this is so he can figure out what to do with the inmates and finally close down the black eye of the beacon of freedom.

One of the big arguments about Obama closing down Gitmo is what to do with all the inmates. Well we might have a solution now:

Switzerland is ready to consider taking in detainees from the U.S. prison for terrorism suspects at Guantanamo Bay in Cuba if that helps to shut it down, the Swiss government said on Wednesday.

"For Switzerland, the detention of people in Guantanamo is in conflict with international law. Switzerland is ready to consider how it can contribute to the solution of the Guantanamo problem," the government said in a statement.

Switzerland said it welcomed the expressed intention of U.S. President Barack Obama to close the prison and would investigate security and legal implications of possibly taking in detainees. About 255 men are still held there.

Help from the world. That’s something we haven’t seen in a very long time. It’s a sign of the change that is coming and the hope and optimism Obama has given the world. Of course I got a better idea for the detainees. Send them to live with Bush and Cheney.

Oh my – so Obama was interviewed by prosecutors last week about the Blago scandal. We found out yesterday in the released report from the transition team. Since the report showed no improper contact, the idiots on the right have to make up some new scandal. Perhaps Hugh Hewitt can be charged with this crusade:

Further, the interview occurred on the 18th, and it wasn't disclosed until today?  What happened to transparency?

How dare team Obama break the golden rule! Don’t they know that as soon as this happened, they were supposed to contact Hugh? I mean, come on. How dare they make someone wait 3 business days to find out! We are talking about Blago, not little things like outing a CIA agent or anything. National security is small potatoes compared to some greedy, idiotic governor trying to get rich.
